Why is Donald J. Trump under a Federal gag order? Because he publicly attacks Federal workers in the judicial system, like judges, clerks, prosecutors, knowing that his base will use that as justification to physically and verbally intimidate these judicial workers. 

If this was about gagging someone simply for speaking out against the case against them and saying that they have no case, the prosecutor is going beyond their limits to prosecute them, then this gag order doesn't happen, because that would be a clear violation of the First Amendment. 

But no American has the constitutional right to defame, to threaten, or incite violence, against another American. Judge Tanya Chutkan knows that and is enforcing this order, to protect her staff, as well as the prosecutors in this case.
